Rules and Regulations Under Articles 18 and 36

Exercising the power granted to it under Article 18 and 36 of the Physical Training and Sports Law No. 8/1978, North Cyprus Tennis Federation makes the following Rules and Regulations. .

    Short Name:

    1 This set of rules and regulations is named as “the Rules and Regulations (Amended) of North Cyprus Tennis Federation and is read together with the rules and regulations of the North Cyprus Tennis Federation seen below, known as the Main Law.

    Interpretation:

    2. Unless indicated otherwise within the text:

   “Association” shall mean the clubs and organizations dealing with sports;

   “Federation” shall mean North Cyprus Tennis Federation;

   “President” shall mean the President of North Cyprus Tennis Federation;

   “Sportsman” shall mean a tennis player dealing with the sport of tennis.

 

   Name of the Federation:

    3. Name of the organization is North Cyprus Tennis Federation.

    Address of the Federation:

 

   4. Federasyonlar Lokali, Lefkoţa (Clubhouse of Federations).

 

   Objective of the Federation:

   5. It regulates, administers, spreads all over the country, promotes, the activities in the field of tennis in accordance with international rules and regulations and represents the State in this field both nationally and internationally.

 

   Admission to the Federation:

   6. Those associations that deal with the sport of tennis carry the qualifications required by the Rules and Regulations and have been registered to the Department of Sports and that pay their subscription fees shall be admitted to the membership of the Federation by the Executive Committee, after their situation is examined by the latter.

 

   (1) Conditions for membership to the Federation are as follows:

(a)    The applying association must possess at least one tennis court or;

(b)   That it must have a tennis court in the area it is located and must have a written permission that it may use such courts;

      (c)    It must be in a position to issue licences to at least four sportsmen;

      (d)   Those associations that do not meet these criteria are admitted as temporary members for a period of one year.

    (2) Temporary-member associations shall not cast vote at the general assembly meetings of the Federation.

    (3) Those associations who are believed to have met the required conditions, as a result of an evaluation to be made by the Executive Committee of the Federation, at the end of one year are passed to the status of permanent member and are entitled to cast their vote at the General Assembly meetings.

 

Renewal of Membership

 7. As the first-time registration fee, the member associations of the Federation shall pay ten per cent (10%) of the minimum wage that is in force during the relevant period in the TRNC. The member associations of the Federation shall renew their registration for each calendar year by paying five per cent (5%) of the minimum wage that is in force during the relevant period in the TRNC.

 

Expulsion from membership

 8. An association may be expelled from the temporary or permanent membership of the Federation in compliance with provisions of the Physical Training and Sports Law, Rules and Regulations on Penalties and the present Rules and Regulations.

 9. The Federation is governed by the following committees:

General Assembly

 A.     GENERAL ASSEMBLY

10. General Assembly is the superior organ of the Federation. It is composed of the President of the Executive Committee and one representative from each of the member-associations of the Federation.

 

Functions of the General Assembly

 11. Functions of the General Assembly is as follows: Electing the President of the Executive Council, approving the members of the Executive Committee, amending the Rules and Regulations depending on time and necessity, carrying out controls to ensure that activities of the Federation are performed in an orderly manner.

Regular General Assembly Meeting

 12. The General Assembly convened regularly in January each year upon the summons of the President or the Executive Committee. Venue, day, time and the agenda of the meeting are reported to the member- association in writing, at least one week in advance and such information is displayed on the notice board at the clubhouse of the Federation. This is also published in at least one Turkish newspaper.

 

Congress Council

 13. In such cases where the term in office of the President of the Federation has not been completed or his term in office has not expired for some reason, he presides over the General Assembly. A congress council is formed from among the representatives of the member-associations and by way of the election of two secretaries who have obtained the highest number of votes.

 

Vacancy in the Post of the President of the Federation

 14. In the event that the President resigns from his post before the completion of his term in office or that the post of the President remains vacant for any reason, the General Assembly is presided over by the Secretary-General of the Federation. In the wake of the collective resignation of the President and Executive Committee, the General Assembly is presided over by the Director of the Sports Department.

 

Quorum for the General Assembly

 15. General Assembly meeting is opened by the President of the Federation. A roll on call is carried out to see whether or not a quorum for the convening of the meeting exists. In order for the General Assembly meeting to be able to convene, more than half of the total number of members must have gathered.

 16. If the quorum cannot be obtained at General Assembly meeting, a half-an-hour waiting period is observed, at the end of which the session of the General Assembly is opened by the presence of at least one-third of the total number of members. In case such a majority cannot be obtained either, the meeting is adjourned until after one week, to be held at the same time and on the same day. In such a case the session is held, regardless of the number of members. Clubs who do not take part in the General Assembly meetings on two consecutive occasions are expelled from the activities of the Federation.

    17. Presidents of the member-associations or representatives serving at the active organs of the member-associations present to the President of the General Assembly, the seal of their association and a document bearing the signature of the President of the General Assembly and the name and duration of representation of that particular representative.

Right to vote

 18. The President of the General Assembly and each representative are entitled to one vote each. In case of a tie (equality of votes), the President shall have a casting vote.

 19. Only those topics on the agenda may be debated at the General Assembly meeting. However, topics, the debating of which is requested by one more than half the members who are present at the meeting, are included in the agenda.

 20. At a General Assembly meeting, decisions are taken with the majority of votes of the members who are present at the meeting. However, the majority obtained must be more than one-fourth of the total number of members.

 21. In order to give a positive or negative decision for an article or articles that have not obtained the required majority of votes as stipulated in Article 20, such an article or articles shall be submitted to the approval of the General Assembly at most twice (two rounds). As to those issues that have not obtained again the required number of votes, a General Assembly meeting is held for only once, in light of an agenda including the related articles only, for making a final decision.

22. Minutes and decisions of the General Assembly are undersigned by the congress council and delivered to the Executive Committee of the Federation to be kept under custody.

Extraordinary Meeting

 23. General Assembly may be summoned for an extraordinary meeting in the wake of important and urgent issues.

 

A. EXTRAORDINARY MEETING

(An extraordinary meeting may be convened:)

 

(a)    Upon the decision of the President of the Federation or the Executive Committee;

(b)   Within one month the latest from the written request of more than one-third of the member-associations of the Federation and the taking of the decision upon the written or verbal summons of the President of the Federation or the Executive Committee or from the communication of the request or demand. Executive Committee of the Federation must be notified of the required reasons and the topics on which a debate is requested in the written demands that have been done for the convening of an extraordinary meeting. Otherwise, requests for meeting are ignored. Topics that are off the agenda shall not be debated in any manner.

Agenda for the Extraordinary General Assembly Meeting is drawn up by the President of the Federation or the Executive Committee, taking into consideration of the demands made.

 

B.     EXECUTIVE COMMITTEE

24. The President of the Federation is elected for a period of two years, by the General Assembly with the majority of votes, from among the Presidential candidates and with the positive votes of more than one-third of the total member-associations of the Federation. In the event that any of the candidates running for Presidency fails to obtain the required number of votes, the election is held by the General Assembly for another two rounds the most. In the event it becomes impossible again to have the required number of votes, the Presidential elections are by the General Assembly to be held later (after 15 days the latest), as required by the agenda and/or by the provisions of the Rules and Regulations.

 25. Those persons who wish to run for Presidency of the Federation shall submit their applications to the Federation at least 48 hours in advance of the elections. Executive Committee is obliged to declare a list of qualified Presidential candidates by way of displaying them on the notice board of the Federation 24 hours in advance of the elections.

 26. Qualifications sought with the candidates applying to run for Presidency of the Federation are as follows:

 

a)      To be a citizen of the T.R.N.C.

b)      To have completed the age of 25.

c)      Not having been convicted of a dishonourable offence.

 27. After the elections, the President of the Federation submits the names of the Executive Committee in the form of a list to the approval of the General Assembly. The majority is established with more than half of the votes of the members who are present at the meeting and with more than one-third of the votes of the total number of members. In case the list is not approved by the General Assembly, the President seeks the approval of the General Assembly for two more times by way of changing his list. In case he fails again to obtain the required approval, the President is dismissed and another election is held at the next General Assembly meeting to be convened after 15 days the latest.

28. Those who will assume duties at the Executive Committee of the Federation must not have been at the active organs of the member-associations and must not be active sportsmen.

   The Executive Committee is composed of the following members:

29. PRESIDENT

 Functions of the President

    .He represents the Federation in line with the spirit of the Physical Training and Sports Law and the Rules and Regulations of the Federation.

   He presides over and administers the General Assembly, Executive Committee and the Disciplinary Committee. He implements or instructs the others to implement the decisions made. He carries out the necessary work for ensuring the application of the international tennis regulations and for training coaches and referees.

   He undersigns licenses and other certificates of achievements and correspondence. He summons the General Assembly or the Executive Committee for an Extraordinary Session, when he deems necessary. He appoints new members for the Executive Committee and the Disciplinary Committee, when vacancies arise in the memberships of such committees and submits these appointments to approval at the first General Assembly meeting. He makes public statements in the name of the Federation.

   VICE PRESIDENT (Administrative):

   He assists the President with his functions, presides over the Executive Committee during the President’s absence and draws up the annual activity report.

   VICE PRESIDENT (Technical):

   He assists the President with regard to all the technical issues, ensures coordination among the members of the Executive Committee who are in charge of the technical issues, assumes duties in all the organizations, and draws up monthly activity reports.

 

Functions of the Secretary General

    SECRETARY GENERAL:

He carries out all the correspondence and keeps the minutes of the meetings of the Executive Committee.

 Functions of the Accountant/Treasurer

 

   ACCOUNTANT-TREASURER:

   He is in charge of all the financial affairs of the Federation. He keeps the book or books containing the Revenues, Expenditures and the expenses incurred. He keeps the receipts and similar documents. He keeps the accounts of the General Assembly, Executive Committee and the Federation ready for those authorities that are empowered by laws to audit the above-mentioned accounts. He deposits all the revenues collected on behalf of the Federation at a bank account. He has the authority, together with the President, to draw money from the bank.

 

Functions of the Member In Charge of Sportive Affairs

    MEMBER IN CHARGE OF SPORTIVE AFFAIRS

   He ensures the orderly realization and organization of the national or overseas competitions. He also ensures the harmony in relations between the member-associations and the sportsmen on one hand and the Executive Committee on the other, and supplies information to the Executive Committee on these issues. He makes proposals. He draws up the annual activity report in compliance with the President’s instructions.

 

Functions of the Member In Charge of Press and Public Relations

   MEMBER IN CHARGE OF PRESS AND PUBLIC RELATIONS

   He ensures the reporting of all the activities of the Federation to the press and media organs. He also ensures that the realization and results of the competitions are communicated in an orderly manner to the public.

   Functions are not restricted to the above-mentioned ones. The President may give additional duties, he may wish, to the members of the Executive Committee. In case the persons who will assume duties are away from their posts temporarily (with a valid excuse), those who will act for them are designated by the President. Functions of the members of the Executive Committee may be changed by the President whenever he deems necessary.

MEMBER IN CHARGE OF FOREIGN AFFAIRS:

   He ensures the orderly realization at home of competitions of international nature, with the approval of the Executive Committee, searches the contact possibilities abroad, and manages relations with foreign associations and organizations.

MEMBER IN CHARGE OF RELATIONS WITH REGIONAL REPRESENTATIVES:

 He ensures coordination between the representatives that will be commissioned in organizations to be held in the regions on one hand and the Federation on the other and informs them of the decisions of the Executive Committee.

MEMBER IN CHARGE OF REFEREE AFFAIRS:

  For ensuring the orderly realization of tennis competitions, he makes proposals to the Executive Committee for the necessary referee appointment, controls the results of competitions, records them in an orderly manner, draws up a report at the end of each organization and supplies information to the Executive Committee.

MEMBER IN CHARGE OF SOCIAL AFFAIRS:

   He organizes every kind of activity that would raise revenues for the Federation, draws up the necessary programme at the end of the competitions, and ensures the orderly offering of hospitality.

 

   Accountability of the Executive Committee

 30. The Executive Committee is the most active organ that has the power of execution in the Federation. The responsibility of the Executive Committee is common and it is collectively accountable to the General Assembly for the reason of non-compliance with the provisions of Rules and Regulations.

 

Working Order

 31. Members of the Executive Committee are obliged to maintain the joint front and harmony. Those members who do not agree to the decisions of the Committee are obliged to comply with the decisions of the majority and not to disclose any dispute within the Committee, so long as they do not resign from their posts in the Committee.

 

 Activity Report

 32. At the end of each year of activity, the Executive Committee draws up an activity report showing its activities and delivers it to the Sports Department.

33. The Executive Committee convenes once at least every fortnight, upon the summons of the President or the person acting for him and with the participation of half the number of members of the Executive Committee, plus one member. At such a meeting, decisions are taken by the majority vote of the members who are present at the meeting.

34. Members of the Executive Committee are obliged to be present at the meetings of the Council. Committee members, who do not take part in three consecutive meetings of the Committee without any reasonable excuse, may be dismissed with the majority of votes of the Executive Committee.

 

D.     DISCIPLINARY COMMITTEE

Establishment of the

Disciplinary Committee

35.            Exercising the power granted to it by the General Disciplinary Rules and Regulations, the Federation establishes its own Disciplinary Committee.

36.            Disciplinary Committee of the Federation has the power of starting and finalizing legal proceedings on all of those indicated in the Disciplinary Statutes, in light of exceptions indicated in the General Disciplinary Rules and Regulations, against organizations and persons affiliated to it.

 

Working Order of the Disciplinary Committee

37.            Disciplinary Committee of the Federation acts in accordance with the working order of the General Disciplinary Committee, indicated in the General Disciplinary Rules and Regulations. On issues not indicated in the General Disciplinary Rules and Regulations, Disciplinary Committee of the Federation is empowered to take all sorts of decisions.

 

FINANCIAL PROVISIONS

Revenues of

 38.            REVENUES OF THE FEDERATION:

1.      Annual fee for the renewal of membership received from the member-associations;

2.      Revenues obtained from the matches and tournaments;

3.      Revenues obtained from the issuance of licences;

4.      All sorts of broadcasting or publishing;

5.      Revenues from fines;

6.      Budgetary contribution share, obtained from financial budget of the TRNC State;

7.      Other revenues.

 

Failure to Pay the

Subscription Fee

39.            In case they fail to pay their annual subscription fees they are obliged to pay, the member-associations are barred from taking part in the activities of the federation.

 

Collections of

Money

 40.            Any collection of money to be made in the name of Federation in return of a receipt with counterfoils or copies. All these receipts are undersigned by the Accountant-Treasurer or his proxies.

 41.            No one is empowered to collect money in the name of Federation other than the Accountant-Treasurer or the person authorized to act for him.

42.            The Accountant-Treasurer must not keep an amount of money, which exceeds 0.2 per cent (0.2%) of his annual budget in his moneybox for a period of more than one week; instead, he must deposit it in the bank account of the Federation. No drawing can be made from the bank without the signatures of the President and the Accountant-Treasurer or their authorized proxies.

43.            For expenditures exceeding the minimum wage that is in effect in the TRNC in the relevant period, the President and the Accountant-Treasurer or their authorized proxies cannot make joint payments without the decision of the Executive Committee.

44.            With the decision of the Executive Committee, the President is empowered, on behalf of the Federation; to undertake all sorts of commitments, receive loans, to file a lawsuit, carry out proceedings regarding withdrawing a lawsuit and other related proceedings that would serve the attainment of the objectives of the Federation. 

 

Financial responsibility

Of Special Committees

 45.            Any activity that would serve the attainment of the objectives of the Federation, and that would place the Federation under financial responsibility, the realization of which shall be decided upon by the Executive Committee, may be carried out under the financial responsibility of special committees, composed mainly of the members of the Executive Committee.

 

Cash Assistance

 46.            Regarding the issues believed to help attain the objectives of the Federation and in line with the decision to be taken by the Executive Committee, persons or teams may be granted cash assistance enabling them to cover their expenses in kind or in return of services.

 

Press and Media

47.            Official statements and information to be delivered to the organs of press and media by the President of the federation and the person he will empower.

 Committee of Inspection

 48.            An action on any subject by the Federation may be inspected by a special committee to be composed of three persons to be designated by the decision of half the number of member-associations, plus one member-association, and to elected by the General Assembly with a majority of votes. 

 

Qualifications and Licensing

49.            Qualification and licensing procedures of the sportsmen of active member-associations of the Federation are carried out in line with the “Qualification and Licensing Statutes”.

 Visaing of the Licenses

 50.            Licenses that are issued are visaed each season. Licenses that are not visaed shall not be valid and the license holder shall not take part during that season in any Official Competition.

 Annual subscription fee renewal

 51.            For each license they issue, the member-associations shall pay the Federation, in return of a receipt, a fee amounting to 5% of the annual subscription renewal fee.

 

Sportsmen of foreign nationalities

52.            Each association shall have two sportsmen of foreign nationalities in their eight-person competition team, only in the major (senior) category. These players cannot be exchanged with another player within that particular season.

 

OTHER PROVISIONS

 

Establishment of committees

 53.            The President of the Federation may establish committees that may help attain the objectives of the Federation with the decision of the Executive Committee and may assume their chairmanship. He may also designate a member of the Executive Committee to chair such committees.

The Member-Associations

 54.            Member-associations shall report to the Federation, the names and functions of those who have been elected to the Executive Committee, within 15 days the latest from the holding of the elections.  

 

Sportsmen Who

Resign from an Association

 55.            In case they fail to present a certificate of good service, those who have resigned from their associations cannot take part for one season in Official Team Competitions. Those sportsmen who have resigned from their associations must indicate which club they wish to go to in their resignation documents.

 56.            Associations must indicate which association their sportsmen, about whom they deliver certificates of good service, shall transfer to.

 57.            Duration of the transfer of sportsmen is determined by the Executive Committee and begins by reporting it to the members in writing at least 15 days in advance and by publishing it as a notice in at least one Turkish newspaper and ends at 19.00 hours on the 14th day from the date of notice.

             In addition to this, in the event that half the total number of the member-associations- plus one member-association, make a written application, the Executive Committee of the Federation may extends the duration of the sportsmen for seven additional days.

58.            Pending the month of the transfer, any sportsman may apply to be transferred to one association only and for once and again, pending the month of the transfer he may withdraw his application and return to his previous club.

 59.            Two years after his term of penalty expires, a sportsman who makes a penalized transfer may re-apply for a penalized transfer.

60.            Pending the term of the penalty of a sportsman whose penalty has been given by the Disciplinary Committee cannot be transferred.

 61.            Federation carries out all the transfer procedures in compliance with the “Rules and Regulations of the Transfer of the Sportsmen”. Transfers made are submitted to the approval of the first convening General Assembly.

62.            The relevant teams of those Associations that have not taken part for two consecutive times in the Official Competitions held by the Federation are reduced to a lower league. If there is no lower league to reduce them, they are expelled from the activities and their sportsmen are set free and the Associations pay the Federation as a fine, for each Official Competition they have failed to take part in, twice the amount of the annual subscription renewal fee.

              If the those associations that have not taken part times in the Official Competitions give a valid reason for not doing so and this reason is accepted by the Disciplinary Committee, they are not subjected to procedures stipulated in this Article.

 

Penalties

63.            Those associations that have departed from the Official Competitions held by the Federation without completing them duly are considered not to have participated and are subjected to the provisions of Article 62.

TRANSITIONAL PROVISIONS

 Transitional Provisions

 64.            Until the General Assembly approves the “Competition Statutes” and “Referee Statutes”, all the procedures on such issues shall be carried out by the directives to be issued by North Cyprus Tennis Federation.

 

Coming into Force

 65. The present Rules and Regulations come into force on the date they are published in the Official Gazette.

66. With the publishing of the present Rules and Regulations in the Official Gazette, the Transitional Rules and Regulations for the Establishment of Cyprus Turkish Tennis Federation, published in the P.I.632 of the Official Gazette, are annulled without prejudice to the procedures carried out so far.
